This Agreement (“Agreement”) is entered into between you, hereinafter referred to as the “User,” and Astart LLC FZ, doing business as bunpun (“bunpun”), a Private Limited Company incorporated in the United Arab Emirates, Dubai, hereinafter referred to as “us,” “we,” or “our.” Please carefully read and consider the following terms and conditions before utilising the website — www.bunpun.com operated by bunpun (“website,” “service”).

In addition, when using particular services or materials on this Platform, Users and Actors shall be subject to any posted rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms of Service. All such guidelines or rules are hereby incorporated by reference into these Terms of Service.

These Terms of Service are effective as of 15 April 2024. We expressly reserve the right to change these Terms of Service from time to time without notice to you.

We reserve the sole right to either modify or discontinue the Platform, including any of the Platform’s features, at any time with or without notice to you. We will not be liable to you or any third party should we exercise such right. Any new features that augment or enhance the then-current services on this Platform shall also be subject to these Terms of Service.

Definitions:

“Actor”: Refers to any individual or entity listed on the Platform with their profiles and details, providing Services through the Platform.
Account: For these Terms And Conditions, an “Account” refers to the individual user’s personal and secure profile on the bunpun platform. It typically includes user-specific information, such as username, email, location, password, and payment details, which are used to access and utilise the services offered on the platform.
“Services”: Refers to the communication facilitation service and other services as provided by bunpun on its Platform between Users and Actors.
Community Service: For the purposes of these Terms of Use, “Community Service” refers to voluntary activities undertaken by users or actors that aim to contribute positively to the community. This includes, but is not limited to, social work, environmental conservation efforts, educational support, charitable tasks, and other forms of assistance aimed at improving the well-being of individuals and the community as a whole
“User”: Refers to any individual or entity accessing or using the Platform. The User is using the Platform for requesting/availing Services and paying for the same.
“Escrow Period”: Once the payment is done by the User, the Platform retains the amount for a period from the payment at the time of the request to 3 (three) days post the video performance before transferring the Actor’s share to the Actor after the video has been approved. The duration of the Escrow Period allows users to review the delivered service before the payment is automatically released to the Actor unless a dispute is initiated by the User within this 3-day timeframe.

Acceptance of the terms:

Your use of the Services is contingent upon your acceptance of these Terms. Please take the time to carefully read and understand these Terms before proceeding with the use of our platform. These Terms do not override or alter any other agreements you may have with bunpun for various products, services, or arrangements. We kindly request that you read these Terms thoroughly. By accessing or using our Services, you signify your agreement to comply with and be bound by these Terms and any other terms referenced herein. If you do not consent to all of these Terms, please refrain from using our Services.

Platform Usage:

The Platform serves as a medium for Users to seek Services, communicate with Actors and request specific actions/Services. Users agree to abide by the guidelines and standards set by bunpun in using the Platform.
Your use of the Platform is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the Platform. By posting information in or otherwise using any communications service, chat room, message board, newsgroup, software library, or other interactive service that may be available to you on or through this Platform, you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content — including text, communications, software, images, sounds, data, or other information — that:
Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies
Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability
Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party
Constitutes unauthorised or unsolicited advertising, junk or bulk email (also known as “spamming”), chain letters, any other form of unauthorised solicitation, or any form of lottery or gambling
Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of any third party
Impersonates any person or entity, including any of our employees or representatives

User-Actor Interaction:

Users may request actions from Actors through the Platform. Actors reserve the right to accept or reject User requests based on their discretion. Terms of Using this Platform for Actors is provided in “Terms and Conditions Agreement – Actors” below. Users agree to provide clear and lawful instructions/requests/communication to Actors through the Platform.
We neither endorse nor assume any liability for the contents of any material created, streamed, uploaded or submitted by third party users of the Platform. We generally do not pre-screen, monitor, or edit the content requested by Users and posted by Actors. However, we have the right at our sole discretion to remove any content that, in our judgment, does not comply with these Terms of Service and any other rules of user conduct for our site, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such content. We shall not be liable in a monetary, legal or any capacity in case where your request is violative of our terms or any applicable laws. You hereby consent to such removal and waive any claim against us arising out of such removal of content. You agree that we may at any time, and at our sole discretion, terminate your membership, account, or other affiliation with our site without prior notice to you for violating any of the above provisions. In addition, you acknowledge that we will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.

Accessing the Platform:

bunpun Platform is a property of Astart LLC FZ. bunpun does not guarantee continuous availability or uninterrupted access to the Platform, its services, or content. We retain the right to suspend, withdraw, discontinue, or modify any part of the website, our Services or Platform without prior notice. bunpun shall not be held liable if the Platform becomes temporarily or permanently unavailable for any reason. Users should monitor the Platform for any announcements regarding changes or updates.

bunpun disclaims responsibility for the quality of the stream, technical issues, adequacy, and content, behaviour of Users/Actors on the website. We do not assert, claim or guarantee that the content available through the website is suitable or accessible in all locations. Additionally, bunpun reserves the right to limit the availability of the website, services, or projects to specific individuals or geographic areas at any given time without any prior notice or communication.

Age Restriction:

Platform is designed to be used only for legal adults. You must be a minimum of 18 (eighteen) years old to use this Platform. By accessing and using the website, you confirm that you meet the age requirement and can legally adhere to this Agreement. bunpun assumes no responsibility for liabilities arising from misrepresentation of age.

ELIGIBILITY

By accessing or using bunpun’s platform, you represent and warrant that:
You are at least 18 years of age or older.
You are not prohibited by any applicable laws or regulations from using our platform.
You have provided accurate and truthful information when creating your bunpun account.
You have not been previously suspended or banned from using bunpun’s platform.
If you are using the platform on behalf of an entity or organisation, you have the authority to bind that entity to these Terms.
You will comply with all applicable laws, rules, and regulations when using bunpun’s platform.

bunpun reserves the right to verify your eligibility and may, at its discretion, request additional information or documentation to confirm your eligibility. Failure to meet these eligibility criteria may result in the suspension or termination of your account.

Intellectual Property:

You agree that all materials and services provided on this website are the property of bunpun, its affiliates, directors, employees or licensors including all the copyrights, trade secrets, trademarks and patents and other intellectual property. You will also agree not to reproduce or re-distribute the bunpun’s intellectual property in any way, including electronic, digital or new trademark registrations.

By using this website, you acknowledge that all materials and services, including but not limited to copyrights, trade secrets, trademarks, patents, and other intellectual property rights, are owned by bunpun, its affiliates, directors, employees, or licensors. While you agree not to reproduce or redistribute any of bunpun’s intellectual property for commercial purposes without explicit permission, you are granted the limited right to post or repost videos provided by bunpun to other platforms for non-commercial use. Similarly, bunpun reserves the right to post or repost such content across various platforms.

User Obligations:

Users agree to provide accurate and truthful information when creating an account and submitting requests on the bunpun platform.
Users shall respect the privacy and personal boundaries of Actors and other users on the platform.
Users are responsible for the content and details of their requests, ensuring they comply with the content guidelines.
Users shall promptly complete the payment process for accepted requests and understand that failure to do so may result in suspension or termination of their account.
Users shall communicate respectfully and professionally with Actors, refraining from abusive, threatening, or offensive language.
Users acknowledge that they have read and understood the terms regarding request creation, payment, and refunds.
Users shall only make authorised payments for the Services on the bunpun platform using their own accounts or authorised accounts only.

Content Guidelines:

The utilisation of the Website and its content is entirely voluntary and falls under the sole and exclusive responsibility of the user. Users may access the content and services through the means or procedures provided on the Website or commonly used on the Internet for this purpose, ensuring compliance with intellectual property rights and refraining from causing any harm to the Website, its information, or the services offered.

Users expressly confirm their agreement to adhere to all terms and conditions, including a commitment to refrain from creating, requesting, or participating in any content that is abusive, harassing, sexually explicit material, nudity, pornography, promotion of drugs, alcohol, tobacco, gambling, violence, terrorism, illegal activities, hate speech, discrimination, intolerance, prejudice (race, ethnicity, religion, gender identity, sexual orientation, disability), misinformation, conspiracy theories, public health/safety undermining, cyberbullying, threats, privacy violations, self-harm, suicide, intellectual property violations, and animal cruelty or promotes any form of harmful or inappropriate activities. This prohibition encompasses content that is offensive, illegal, or violates ethical standards, laws, regulations, code of conducts, etc. Any violation of these content guidelines may result in immediate termination of service.

Acceptable Content:

Users are expected to adhere to the following comprehensive content guidelines when creating and submitting requests on the bunpun platform:
Requests must not contain any illegal, harmful, abusive, harassing, nude, sexually explicit, harassing, nude, or any other content deemed harmful or inappropriate. This includes but is not limited to content that promotes violence, discrimination, or hatred.
Content should not endorse or promote the use of drugs, alcohol, smoking, or any other substances or activities that may be harmful, illegal, or against community standards.
Content should not violate any applicable local, national, or international laws and regulations.
Content should not infringe upon the intellectual property rights, including copyrights, trademarks, or other proprietary rights of third parties.

Review and Rejection: bunpun reserves the right to review and reject any request or content that does not comply with these comprehensive content guidelines. If a request or content is found to violate these guidelines, it may be removed or modified at the discretion of bunpun.

User Responsibility:

Users are solely responsible for the content of their requests, any associated materials they provide on the platform, and ensuring compliance with these comprehensive content guidelines
Users acknowledge and agree that they will not hold bunpun liable for any consequences arising from non-compliance with these guidelines.
Users are expected to adhere to community guidelines, and any violations may result in account suspension or termination.

bunpun’s rights:

bunpun reserves the right to remove any content deemed inappropriate without prior notice and may report any illegal activities to the relevant authorities.
bunpun employs technology services to identify and promptly ban any abusive or inappropriate requests submitted by users.
Streams containing content deemed inappropriate will be either blurred or cancelled at the discretion of the platform, ensuring a safe and respectful environment for all users.

Reporting Violations:

Users are encouraged to report any content that they believe violate bunpun’s guidelines by contacting bunpun’s Support Team or using the reporting mechanisms provided on the platform.

bunpun will investigate reported violations and take appropriate action as necessary, including content removal, suspension, or termination of user accounts.

Third Party Websites:

This site may link you to other sites on the Internet or otherwise include references to information, documents, software, materials and/or services provided by other parties. These sites may contain information or material that some people may find inappropriate or offensive.

These other sites and parties are not under our control, and you acknowledge that we are not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites, nor are we responsible for errors or omissions in any references to other parties or their products and services. The inclusion of such a link or reference is provided merely as a convenience and does not imply endorsement of, or association with, the Website or party by us, or any warranty of any kind, either express or implied.

Content Storage and Access:

Users acknowledge that streams are not uploaded but are available as streams on the profiles of actors, accessible by Users. The company maintains a recording of the videos as evidence in the event of disputes and to facilitate resolution.

User Accounts:

As a user of this website, you may be requested to register with us and provide personal information. You are responsible for ensuring the accuracy of this information and for maintaining the safety and security of your identifying details. Additionally, you are accountable for all activities conducted under your account or password. In the event of suspected security issues with your account, please promptly inform us for appropriate resolution to prescribed details as mentioned hereinbelow.

We reserve the right, at our sole discretion, to terminate accounts, edit or remove content, and cancel orders to maintain a secure and compliant online environment.

Furthermore, users are required to input their card details upon request submission. However, no funds will be deducted initially; they are held in reserve until the request is fulfilled or the payment deadline elapses. The website retains the funds for a duration of three days until the submitted video is approved. If the submitted video is not disputed, the funds are debited from the account. Please refer to the “Payments clause” for a comprehensive understanding of the payment process. bunpun aims to provide a transparent and secure transaction experience for our users from their embedded wallet and the Users have to credit this wallet to pay for streaming. Users can credit and withdraw the funds. Withdrawal will work when Users have over USD25 equivalent as balance. Users are solely responsible for all commission and FX conversions on their end. bunpun will instruct its payments partner Stripe to execute the request transfer at face value, when the wallet is credited with money, it will be held on Stripe escrow infrastructure.

Additionally, upon submitting a request, users are required to provide their card details. It’s important to note that no charges will be made at the time of submission, immediately. Instead, the funds are temporarily held until either the request is completed, or the payment deadline is reached, which is 3 (three) days from the date of submission of video by Actor. Should there be no objections raised within three days following the service delivery or submission of video by Actor, the reserved funds will automatically be released to the Actor, with our fee being transferred to us. In the event of a complaint or objection being filed/raised duly within 3 (three) days from date of submission of video, we will initiate an investigation and may withhold the payment if the complaint is found to be justified. For a detailed explanation of our payment process, please refer to the “Payments clause”. Our goal is to ensure a transparent and secure transaction process for all our users.

Engagement Clause:

The engagement commences when a User posts a task along with a proposed price. Actors have the autonomy to select tasks, negotiate prices, and initiate engagements. The selection process is user-driven, allowing both actors and Users the freedom to choose their engagement partners.

At the agreed-upon time, the actor starts a live stream through the platform. The User receives a unique link to view the live stream, with a chat feature facilitating real-time communication between the actor and the User.

Users can opt for either a private or public stream. In a private stream, content is exclusively visible to the User, ensuring confidentiality. In a public stream, the action is listed as “live now” on the platform for broader visibility.

The absence of complaints within three (3) days after the completion of a live stream serves as a conclusive indicator of the legitimacy and successful fulfilment of the streamed action.

By participating in this process, users agree to comply with all platform guidelines , terms, and conditions.

Payments and Refund:

Payment Process: Upon submitting a service request, Users are required to provide card details, but immediate payment is not deducted. Charges are automatically processed, but only upon completion of the service. After the live stream concludes, funds are released within three days unless complaints are raised. Users have to credit their embedded wallet to pay for streaming. Users can credit and withdraw the funds. Withdrawal will work when Users have over USD25 equivalent as balance. bunpun will instruct its payments partner Stripe to execute the request transfer at face value. When the wallet is credited money will be held on Stripe escrow infrastructure.
Streaming Limits:
– For payments up to $10, the maximum streaming time is capped at 15 minutes.
– Payments up to $20 extend the maximum streaming time to 30 minutes.
– Payments up to $40 allow a maximum streaming time of 60 minutes.
Revenue Distribution: The website is entitled to a Service Fee, which is a percentage of the total payment. This fee, amounting to 30% of the transaction, is deducted before crediting the actor’s earnings. The Actor receives the remaining 70% of the transaction amount.
Payment Disputes: If a User believes a booked live Stream did not occur, or believes there is an issue with the quality of a live Stream, they must initiate a dispute resolution process through the Support portal within 3 (three) days of the scheduled stream start time. bunpun will investigate the dispute and attempt to reach an amicable resolution between the User and the Actor.
Refund Policy: Actors and Users acknowledge and agree to bunpun’s refund policy, permitting refunds in the event of a non-occurrence of a scheduled stream or if the stream is deemed of poor quality by the support team. Refund requests should be reported to the designated support email within a reasonable timeframe [support@bunpun.com] bunpun reserves the right to review and process refund requests at its discretion.
Taxes: Users and Actors are responsible for complying with all applicable tax laws and regulations regarding payments made and received on the bunpun platform. bunpun does not provide tax advice or withhold taxes on behalf of Users or Actors.

Streaming and Viewing:

When the Service is ready to be performed, the Actor may use the bunpun platform to:

Initiate a live stream of the Community Service.
Offer the User a secure link to view the live stream.
Enable a chat functionality that allows real-time communication between the User and the Actor during the live stream.

Streams are recorded and made available on the front page as recent streams and on the profile page of each actor. There will be no uploaded videos; only recorded streams will be accessible for viewing.

Users have the option to choose whether the stream is private, viewable only by the User, or public, and will be listed as “live now” on the platform.

bunpun disclaims any responsibility for the quality of streams, technical issues, adequacy, or content of the streams.

Applicable Law and Jurisdiction:

By utilising this website, you expressly agree that the laws of the United Kingdom, without regard to conflict of laws principles, will govern these terms and conditions and any disputes that may arise between bunpun and you, its business partners, or associates.

Any dispute arising in connection with your use of this website or products purchased from us shall be subject to arbitration in the United Kingdom. You consent to the exclusive jurisdiction and venue of the State United Kingdom for the resolution of such disputes.

Dispute Resolution:

Cooperative Resolution: In the event of any dispute, disagreement, or issue arising between Users and Actors on the bunpun platform, both parties are encouraged to initially attempt to resolve the matter through cooperative communication and negotiation.

Escalation to bunpun: If a dispute remains unresolved after a reasonable attempt at cooperative resolution, either the User or the Actor may escalate the matter by contacting bunpun’s support team through the designated communication channels provided on the platform.

bunpun’s Mediation: Upon receiving a dispute notification, bunpun may initiate a mediation process to assist in finding a fair and amicable resolution. Both Users and Actors agree to cooperate with bunpun during the mediation process, providing any necessary information or documentation to facilitate resolution.

Binding Arbitration: In the event that mediation efforts do not lead to resolution, both Users and Actors agree that any remaining disputes, claims, or controversies shall be resolved through binding arbitration. Arbitration proceedings shall be conducted in accordance with applicable arbitration rules and regulations, and the arbitrator’s decision shall be final and binding.

Indemnification:

You agree to indemnify bunpun and its affiliates and hold bunpun harmless against legal claims and demands that may arise from your use or misuse of our services.

Limitation of Liability:

bunpun holds no liability for any damages resulting from your misuse of our website. We are not responsible for interruptions to services, delays, errors, malfunctions, or other issues beyond our reasonable control, including willful misconduct or fault of users, and events classified under Force Majeure. Force Majeure encompasses events beyond our reasonable control, such as third-party failures, government actions, lack of access to third-party networks, natural disasters, power outages, and security breaches by hackers or other third parties.

bunpun assumes no responsibility for any direct or indirect damages, consequential damages, or loss of profits. To the extent permitted by applicable law, bunpun disclaims all liability for damages resulting from the lack of truthfulness, accuracy, completeness, or timeliness of the content transmitted, stored, made available, or received through the website. This includes content provided by third parties or entities.

bunpun is not accountable for the content or information collected on the website, nor for any contributions, opinions, comments, insights, or other communications not directly issued by bunpun.

Amendments:

bunpun reserves the right to edit, modify, and change the content of these terms and conditions from time to time to reflect legal changes or changes to the website or the contents or changes to the Website or the Contents and services offered therein. Consequently bunpun recommends that Users read these conditions each time they access and then use the Website to review the terms applicable at that time.

bunpun may update the Website and change the content, design, presentation and/or the configuration at any time without prior notice.

Termination:

bunpun reserves the right to terminate this Agreement by providing the User with fifteen (15) days written notice. In addition, bunpun may terminate the Agreement if the User fails to comply with any requirements or obligations under the Agreement or violates any applicable laws, legislations, regulations, rules, etc.

User’s Rights and Responsibilities:

Users have the right to expect actors to fulfil agreed-upon tasks satisfactorily and to receive accurate and timely updates on task progress. These rights ensure a transparent and accountable engagement process, fostering a positive experience.

Users are responsible for clearly defining the tasks for actors, providing comprehensive instructions. It is essential to respect the actor’s professional boundaries and refrain from requesting tasks that may compromise their integrity. Adhering to these responsibilities contributes to a respectful and ethical interaction between users and actors on the platform.

Users agree not to host, display, upload, modify, publish, transmit, store, update, or share any information that does not belong to them or violates rights, is harmful, abusive, sexual, harassing, inappropriate, or ethically objectionable. Users must avoid content that harms minors, infringes on proprietary rights, violates laws, impersonates others, contains threats, is false with malicious intent, is defamatory, promotes illegal activities, or falsely associates with bunpun.

Failure to comply with these obligations may result in actions by bunpun, including the immediate withdrawal of usage rights, removal of contributions, warnings, legal proceedings for reimbursement, and disclosure to law enforcement authorities. Compliance with these guidelines is crucial for maintaining a secure and ethical online environment.

Severability:

If any provision of this Agreement is invalid or unenforceable or prohibited by law, it shall be treated for all purposes as severed from this Agreement and ineffective to the extent of such invalidity or unenforceability, without affecting in any way the remaining provisions hereof, which shall continue to be valid and binding.

Grievance redressal:

Users may report illegal activity or information, material or content which is unlawful or violates these Terms and Conditions at any time through an email.

By posting information in or otherwise using any communications service, chat room, message board, newsgroup, software library, or other interactive service that may be available to you on or through this Platform, you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content — including text, communications, software, images, sounds, data, or other information — that:

User-Actor Interaction:

Users may request actions from Actors through the Platform. Actors reserve the right to accept or reject User requests based on their discretion. Terms of Using this Platform for Users is provided in “Terms and Conditions Agreement – Users” above. Users agree to provide clear and lawful instructions/requests/communication to Actors through the Platform. Actors agree to use their discretion to undertake Services requested by Users.

We neither endorse nor assume any liability for the contents of any material created, streamed, uploaded or submitted by third party users of the Platform. We generally do not pre-screen, monitor, or edit the content requested by Users and posted by Actors. However, we have the right at our sole discretion to remove any content that, in our judgement, does not comply with these Terms of Service and any other rules of user conduct for our site, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such content. We shall not be liable in a monetary, legal or any capacity in case where your request is violative of our terms or any applicable laws.

You hereby consent to such removal and waive any claim against us arising out of such removal of content. You agree that we may at any time, and at our sole discretion, terminate your membership, account, or other affiliation with our site without prior notice to you for violating any of the above provisions. In addition, you acknowledge that we will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.

Accessing the Platform:

bunpun Platform is a property of Astart LLC FZ. bunpun does not guarantee continuous availability or uninterrupted access to the Platform, its services, or content. We retain the right to suspend, withdraw, discontinue, or modify any part of the website, our Services or Platform without prior notice. bunpun shall not be held liable if the Platform becomes temporarily or permanently unavailable for any reason. Actors should monitor the Platform for any announcements regarding changes or updates.

Age Restriction:

ELIGIBILITY

By accessing or using bunpun’s platform, you represent and warrant that:

You are at least 18 years of age or older.
You are not prohibited by any applicable laws or regulations from using our platform.
You have provided accurate and truthful information when creating your bunpun account.
You have not been previously suspended or banned from using bunpun’s platform.
If you are using the platform on behalf of an entity or organisation, you have the authority to bind that entity to these Terms.
You will comply with all applicable laws, rules, and regulations when using bunpun’s platform.

Intellectual Property:

Actor’s Obligations:

Actors agree to provide accurate and truthful information when creating an account and submitting requests on the bunpun platform.
Actor shall respect the privacy and personal boundaries of Users on the platform.
Actors are responsible for the content they create and details of their content, ensuring they comply with the content guidelines.
Actors shall promptly complete the deliverance of content for accepted requests and understand that failure to do so may result in poor profile rating, suspension or termination of their account.
Actors shall communicate respectfully and professionally with Users, refraining from abusive, threatening, or offensive language.
Actors acknowledge that they have read and understood the terms regarding request creation, payment, and refunds.
Actors shall only make contents/videos which are lawful, legal, allowed, legitimate and not violative of any applicable laws.
Actors shall share content created on bunpun Platform on third party platforms at their own risk and bunpun shall not be liable for any issues, concerns, claims arising out of the same.
Actors shall not infringe upon any third party ownership, proprietary or IP rights, directly or indirectly or in any manner whatsoever.

Content Guidelines:

The utilisation of the Website and its content is entirely voluntary and falls under the sole and exclusive responsibility of the Actor. Actors may access the content and services through the means or procedures provided on the Website or commonly used on the Internet for this purpose, ensuring compliance with intellectual property rights and refraining from causing any harm to the Website, its information, or the services offered.

Actors expressly confirm their agreement to adhere to all terms and conditions, including a commitment to refrain from creating or participating in any content that is abusive, harassing, sexually explicit material, nudity, pornography, promotion of drugs, alcohol, tobacco, gambling, violence, terrorism, illegal activities, hate speech, discrimination, intolerance, prejudice (race, ethnicity, religion, gender identity, sexual orientation, disability), misinformation, conspiracy theories, public health/safety undermining, cyberbullying, threats, privacy violations, self-harm, suicide, intellectual property violations, and animal cruelty or promotes any form of harmful or inappropriate activities. This prohibition encompasses content that is offensive, illegal, or violates ethical standards, laws, regulations, code of conducts, etc. Any violation of these content guidelines may result in immediate termination of service.

Acceptable Content:

Actors are expected to adhere to the following comprehensive content guidelines when creating and submitting content on the bunpun platform:

Content must not contain any illegal, harmful, abusive, harassing, nude, sexually explicit, harassing, nude, or any other content deemed harmful or inappropriate. This includes but is not limited to content that promotes violence, discrimination, or hatred.
Content should not endorse or promote the use of drugs, alcohol, smoking, or any other substances or activities that may be harmful, illegal, or against community standards.
Content should not violate any applicable local, national, or international laws and regulations.
Content should not infringe upon the intellectual property rights, including copyrights, trademarks, or other proprietary rights of third parties.

Review and Rejection: bunpun reserves the right to review and reject any request or content that does not comply with these comprehensive content guidelines. If a request or content is found to violate these guidelines, it may be removed or modified at the discretion of bunpun.

Actor Responsibility:

Actors and Users are solely responsible for their content, any associated materials they provide on the platform, and ensuring compliance with these comprehensive content guidelines.
Actors acknowledge and agree that they will not hold bunpun liable for any consequences arising from non-compliance with these guidelines.
Actors are expected to adhere to community guidelines, and any violations may result in account suspension or termination.

bunpun’s rights:

bunpun reserves the right to remove any content deemed inappropriate without prior notice and may report any illegal activities to the relevant authorities.
bunpun employs technology services to identify and promptly ban any abusive or inappropriate requests submitted by Users or content submitted by Actors.
Streams containing content deemed inappropriate will be either blurred or cancelled at the discretion of the platform, ensuring a safe and respectful environment for all Actors.

Reporting Violations:

Actors are encouraged to report any content request that they believe violate bunpun’s guidelines by contacting bunpun’s support team or using the reporting mechanisms provided on the platform.

bunpun will investigate reported violations and take appropriate action as necessary, including content removal, suspension, or termination of Actor accounts.

Third Party Websites:

Content Storage and Access:

Actors acknowledge that streams are not uploaded but are available as streams on the profiles of actors, accessible by Users and Actors. The company maintains a recording of the videos as evidence in the event of disputes and to facilitate resolution.

Accounts:

We reserve the right, at our sole discretion, to terminate accounts, edit or remove content, and cancel orders to maintain a secure and compliant online environment.

Furthermore, all users are required to input their account details for transfer of funds subsequent to successful acceptance of the Actor’s content. The website retains the funds for a duration of three days until the submitted video is approved. If the submitted video is not disputed, the funds are debited from the account of the User and transferred into the account of the Actor. Please refer to the “Payments clause” for a comprehensive understanding of the payment process. bunpun aims to provide a transparent and secure transaction experience for our users. bunpun will instruct its payments partner Stripe to execute the request transfer at face value, when the wallet is credited money, it will be held on Stripe escrow infrastructure.

For Actors: When Actors have necessary balance i.e. over $25, they can then provide the details of their bank account and bunpun will execute the withdrawal via Stripe infrastructure.

Engagement Clause:

The engagement commences when a User posts a task along with a proposed price. Actors have the autonomy to select tasks, negotiate prices, and initiate engagements. The selection process is user-driven, allowing both Actors and Users the freedom to choose their engagement partners.

At the agreed-upon time, the Actor starts a live stream through the Platform. The User receives a unique link to view the live stream, with a chat feature facilitating real-time communication between the Actor and the User.

Users can opt for either a private or public stream of the Actor’s content. In a private stream, content is exclusively visible to the User, ensuring confidentiality. In a public stream, the action is listed as “live now” on the platform for broader visibility.

The absence of complaints within three (3) days after the completion of a live stream serves as a conclusive indicator of the legitimacy and successful fulfilment of the streamed action.

By participating in this process, the Users agree to comply with all platform guidelines, terms, and conditions.

Payments and Refund:

Payment Process: Upon submitting a service request, Users are required to provide card details and charges are debited upon submission of the request. Further, charges are automatically processed upon completion of the Service. After the live stream concludes, funds are released from the Users account into the Actors account, within three days unless complaints are raised.
Streaming Limits:
– For every 15 minutes of streaming if the Actor goes live without a request from the User $1.5 equivalent shall be paid to the Actor.
– For payments up to $10, the maximum streaming time is capped at 15 minutes.
– Payments up to $20 extend the maximum streaming time to 30 minutes.
– Payments up to $40 allow a maximum streaming time of 60 minutes.
Revenue Distribution: The website is entitled to a Service fee, which is a percentage of the total payment. This fee, amounting to 30% of the transaction, is deducted before crediting the actor’s earnings. The Actor receives the remaining 70% of the transaction amount.
Payment Disputes: If a User believes a booked live Stream did not occur, or believes there is an issue with the quality of a live Stream, they can initiate a dispute resolution process through the Support portal within 3 (three) days of the scheduled stream start time. The Actor will be informed accordingly. bunpun will investigate the dispute and attempt to reach an amicable resolution between the User and the Actor.
Refund Policy: Both Users & Actors acknowledge and agree to bunpun’s refund policy, permitting refunds in the event of a non-occurrence of a scheduled stream or if the stream is deemed of poor quality by the support team. Refund requests should be reported to the designated support email within a reasonable timeframe [support@bunpun.com] bunpun reserves the right to review and process refund requests at its discretion.
Taxes: Users and Actors are responsible for complying with all applicable tax laws and regulations regarding payments made and received on the bunpun platform. bunpun does not provide tax advice or withhold taxes on behalf of Users or Actors.

Streaming and Viewing:

When the Service is ready to be performed, the Actor may use the bunpun platform to:

Initiate a live stream of the Community Service.
Offer the User a secure link to view the live stream.
Enable a chat functionality that allows real-time communication between the User and the Actor during the live stream.

bunpun disclaims any responsibility for the quality of streams, technical issues, adequacy, or content of the streams.

Applicable Law and Jurisdiction:

Dispute Resolution:

Cooperative Resolution: In the event of any dispute, disagreement, or issue arising between Users and Actors on the bunpun platform, both parties are encouraged to initially attempt to resolve the matter through cooperative communication and negotiation.

bunpun’s Mediation: Upon receiving a dispute notification, bunpun may initiate a mediation process to assist in finding a fair and amicable resolution. Both Users and Actors agree to cooperate with bunpun during the mediation process, providing any necessary information or documentation to facilitate resolution.

Binding Arbitration: In the event that mediation efforts do not lead to resolution, both Users and Actors agree that any remaining disputes, claims, or controversies shall be resolved through binding arbitration. Arbitration proceedings shall be conducted in accordance with applicable arbitration rules and regulations, and the arbitrator’s decision shall be final and binding.

Indemnification:

You agree to indemnify bunpun and its affiliates and hold bunpun harmless against legal claims and demands that may arise from your use or misuse of our services.

Limitation of Liability:

bunpun is not accountable for the content or information collected on the website, nor for any contributions, opinions, comments, insights, or other communications not directly issued by bunpun.

Amendments:

bunpun reserves the right to edit, modify, and change the content of these terms and conditions from time to time to reflect legal changes or changes to the website or the contents or changes to the Website or the Contents and services offered therein. Consequently bunpun recommends that Actors read these conditions each time they access and then use the Website to review the terms applicable at that time.

bunpun may update the Website and change the content, design, presentation and/or the configuration at any time without prior notice.

Termination:

bunpun reserves the right to terminate this Agreement by providing the Actor with fifteen (15) days written notice. In addition, bunpun may terminate the Agreement if the Actor fails to comply with any requirements or obligations under the Agreement or violates any applicable laws, legislations, regulations, rules, etc.

Actor’s Rights and Responsibilities:

Actors have the right to expect due payments from Users when they duly complete their agreed-upon task satisfactorily and the same is not disputed by the User. These rights ensure a transparent and accountable engagement process, fostering a positive experience.

Actors are responsible for understanding the instructions and requests made by the Users and acting upon them accordingly. It is essential for the User to respect the Actor’s professional boundaries and refrain from requesting tasks that may compromise their integrity.

Actors have the right to refuse to take up any tasks/requests that they deem inappropriate, insulting, offensive, disrespectful, etc. Adhering to these responsibilities contributes to a respectful and ethical interaction between Users and Actors on the platform.

Actors agree not to host, display, upload, modify, publish, transmit, store, update, or share any information that does not belong to them or violates rights, is harmful, abusive, sexual, harassing, inappropriate, or ethically objectionable. Actors must avoid content that harms minors, infringes on proprietary rights, violates laws, impersonates others, contains threats, is false with malicious intent, is defamatory, promotes illegal activities, or falsely associates with bunpun.

Severability:

Grievance redressal:

Actors may report illegal activity or information, material or content which is unlawful or violates these Terms and Conditions at any time through an email.
